A newly formulated department known as "The Skill Games Council of India", urged on Wednesday that the Rajasthan government needs to broaden the scope of the draft gaming code by including rules for all online skill games, not just fantasy gaming. The Rajasthan government produced a proposed draft of gaming rules last week, which is a positive step, but it only covers fantasy sports and eSports.
Within this department, a "Gaming Commission' will be established to govern online gaming activity in the state, according to the proposed regulation. According to the proposal, license and advertising offenses will result in a penalty of up to Rs. 2 lakh. There are currently no penalties in place in the state for internet gaming though.
Differentiating between Esports and Fantasy Gaming
The biggest controversy of this whole draft of setting standards to gaming rules is over the fact that Esports as a gaming industry is included within the scope of fantasy gaming, which is historically just about gambling. So, gamers and especially the professional Esports players have been questioning the stance of including them with the definition of the gambling industry, only to impose certain levels of taxes and other strict advertising policies.
Esports are typically characterized as sports in which the use of computer games is essential to conduct the tournament, whether it is a one-on-one format of competitive matches or a team versus team one. Furthermore, he added, there are many firms that run fantasy sports and brand themselves as esports companies. This is probably the reason why the government seems to be in a region of disbelief.
Exclusion of Real Money Gaming
The controversial proposed legislation excludes real-money games like Rummy, Poker, and Ludo from its scope, which the industry is questioning. Because the bill's goal is to govern skill games, it should cover all sorts of skill games without discrimination, according to an industry insider who spoke on the condition of anonymity.
The real-money gaming market in India has exploded in recent years. As per a recent study organized by organizations like EY and FICCI, India's online gaming industry would grow by 28% in 2021 to INR 101 billion, while the number of paying players will climb by 17% to 95 million in 2021 from 80 million in 2020. According to the research, real-money gaming accounted for more than 70% of segment revenues.
Need for a ‘Centralized Approach’ for the gaming industry
NASSCOM said in its reaction to the proposed bill, that the focus for gaming should be on an assisted action between the Centre and the states for gaming specifically. "Instead of adopting a legislation regulating online gaming, the Government of Rajasthan may consider partnering with the federal government's task force on gaming to express its unique concerns and proposals," it stated.
While India has a federal framework, which allows the states to set their own laws, Khurana believes that if there is a national policy for esports, it will be simpler for state legislatures to pass legislation.
The majority of Esports Gamers believe that the gaming industry as a whole should come under the control of states as originally intended. The Centre, on the other hand, should assist states in developing their policy frameworks to include crucial concepts for them to use in developing their own policies.
It's vital that the Center establishes a precise definition of esports that can be used across states. Fantasy sports, like esports, have contributed to the promotion of sports culture. It was emphasized that the very legality of operations should be redefined.
